Professor Patrick Keyzer on the Death of Justice Toohey in The Australian

Professor Patrick Keyzer, Head of La Trobe Law School, was interviewed on 14 April 2015 about the death of High Court Judge John Toohey on 9 April. In an article in The Australian titled ‘Clapsticks and song send Mabojudge on his final journey‘, Professor Keyzer said that“[t]ogether with Justices Deane and Gaudron, [Toohey] really was one of the judges who was enthusiastic about implied rights and freedoms.” Justice Toohey presided over the Mabo (No 2) case, which was a watershed decision in the rejection of the doctrine of terra nullius and the recognition of native title rights in Australia.
